Terms of Service
Last updated: 1 October 2026
Welcome to Noosa Mode.
The terms “we”, “us” and “our” refer to Noosa Mode and its legal operator, Holt Commerce. We operate this website and provide its content, features, products and related services to offer customers an online shopping experience (collectively, the “Services”).
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.
These Terms of Service, together with our Privacy Policy, Returns and Refunds Policy, Shipping Policy and any other policies referenced on our website, explain the rights and responsibilities that apply when you visit our website or purchase from Noosa Mode.
By accessing or using the Services, you agree to these Terms. If you do not agree, please discontinue your use of the Services.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
Section 1 – Eligibility and accounts
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our website.
When using our Services, you may be required to provide information including your name, email address, billing details, payment information and delivery address. You agree to provide information that is accurate, current and complete.
If you create an account, you are responsible for keeping your login details secure and for activity occurring through your account. Please contact us promptly if you believe your account has been accessed without authorisation.
Section 2 – Products and product information
We take reasonable care to present our products accurately, including their descriptions, colours, sizing and images.
Colours and appearance may vary slightly depending on your screen, device settings and lighting. Measurements may also vary slightly where products are measured by hand.
Product descriptions, availability and prices may be updated when reasonably necessary. We may discontinue products or limit quantities where stock is unavailable or where other reasonable supply restrictions apply.
These provisions do not exclude any consumer guarantee or other right available under the Australian Consumer Law.
Section 3 – Orders
Submitting an order constitutes an offer to purchase the selected products.
An order is accepted once we confirm acceptance or begin processing the order. An automated order confirmation acknowledges that we have received your order but may not always constitute final acceptance.
We may refuse or cancel an order where reasonably necessary, including when:
-
A product is unavailable
-
Pricing or product information contains a genuine error
-
Payment cannot be authorised
-
We reasonably suspect fraud or unauthorised activity
-
The delivery address falls outside our service area
-
An order exceeds reasonable purchasing quantities
If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.
Please check your order carefully before submitting it. We cannot guarantee that an order can be changed or cancelled once processing has begun. To request a change, contact info@noosamode.com as soon as possible.
Orders are intended for personal or household use and not for unauthorised commercial resale.
Section 4 – Prices and payment
Unless stated otherwise:
-
Prices are displayed in Australian dollars (AUD)
-
Prices include GST where applicable
-
Any applicable delivery charges will be displayed before you complete checkout
We take reasonable care to ensure that prices are accurate. If an obvious pricing error occurs, we may contact you before processing the order. You may then confirm the order at the correct price or cancel it for a full refund.
Discounts and promotional offers are subject to their stated conditions and availability. Unless expressly stated otherwise, discount codes cannot be combined.
You agree to provide accurate and complete payment information and confirm that you are authorised to use the selected payment method.
Section 5 – Shipping and delivery
Delivery locations, estimated processing times and estimated transit times are set out in our Shipping Policy.
Delivery dates are estimates rather than guaranteed dates. Delays may occasionally occur because of carrier disruptions, public holidays, severe weather, customs processing or other circumstances outside our reasonable control.
We will take reasonable steps to assist if an order is delayed, lost or damaged in transit. Nothing in this section limits your rights where products are not supplied within a reasonable time or otherwise fail to meet a consumer guarantee.
Please ensure your delivery information is complete and accurate. Additional costs resulting from an incorrect or incomplete address may be charged where permitted by law and where the error was not caused by us.
Section 6 – Returns and consumer guarantees
Change-of-mind returns are governed by our Returns and Refunds Policy.
Products sold to Australian consumers come with automatic guarantees under the Australian Consumer Law. Depending on the nature of a problem, you may be entitled to a repair, replacement, refund or another remedy.
Our voluntary 30-day return period does not replace or restrict these statutory rights, which may continue beyond 30 days depending on the circumstances.
Section 7 – Intellectual property
Unless otherwise stated, the website and its original content—including branding, text, graphics, photographs, videos, layout and design—are owned by or licensed to Noosa Mode and are protected by applicable intellectual property laws.
You may use the website for personal, non-commercial shopping purposes.
Without prior written permission, you must not reproduce, modify, distribute, republish, commercially exploit or create derivative works from protected website content, except where permitted by law.
Third-party trademarks and content remain the property of their respective owners.
Section 8 – Optional tools and third-party services
We may provide access to services or tools supplied by third parties, such as payment providers, parcel tracking services or review platforms.
Your use of those services may also be subject to the third party’s terms and privacy practices. We are not responsible for independent third-party services to the extent permitted by law, but this does not limit any responsibility that cannot lawfully be excluded.
Section 9 – Third-party links
Our website may contain links to websites operated by third parties.
We do not control these websites and are not responsible for their independent content, security or privacy practices. Please review the relevant terms and policies before providing personal information or making a transaction through a third-party website.
Section 10 – Relationship with Shopify
Noosa Mode is powered by Shopify, which provides the ecommerce platform used to operate our online store.
Purchases made through this website are transactions between you and Noosa Mode, not between you and Shopify. Questions concerning orders, products, delivery, returns or refunds should therefore be directed to Noosa Mode.
Nothing in this section limits any rights or remedies available under applicable law.
Section 11 – Privacy
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Shopify and other service providers may process information on our behalf to operate the website, process payments, fulfil orders, prevent fraud and provide related services.
Some providers may process or store information outside Australia. Further information about how personal information is collected, used, disclosed and protected is available in our Privacy Policy.
Section 12 – Reviews and feedback
If you submit a review, photograph, suggestion or other feedback, you confirm that:
-
The content reflects your genuine experience or opinion
-
You have the right to submit it
-
It does not infringe another person’s rights
-
Any incentive or compensation connected to the submission has been disclosed
-
It is not unlawful, abusive, defamatory, misleading or malicious
You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use submitted feedback for operating and promoting Noosa Mode.
We may moderate or remove content that breaches these Terms or applicable law. We will not knowingly alter reviews in a way that misrepresents the reviewer’s genuine opinion.
Section 13 – Errors and corrections
Website information may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, delivery charges, transit estimates or availability.
We may correct genuine errors and update information when reasonably necessary. If an error materially affects an order already placed, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling the affected order for a refund.
Nothing in this section permits us to avoid responsibilities imposed by law.
Section 14 – Prohibited uses
You must not use the Services:
-
For an unlawful, fraudulent or malicious purpose
-
To infringe intellectual property, privacy or other legal rights
-
To upload viruses, malware or harmful code
-
To harass, threaten, abuse or impersonate another person
-
To submit false or misleading information
-
To collect personal information without authorisation
-
To send spam or unauthorised marketing
-
To scrape, crawl or interfere with the website without permission
-
To bypass security or access controls
-
To interfere with the operation or security of the Services
We may restrict or suspend access where we reasonably believe these Terms or applicable laws have been breached.
Section 15 – Suspension and termination
You may stop using the Services at any time.
We may suspend or terminate access where reasonably necessary, including in response to unlawful conduct, fraud, security threats or a material breach of these Terms.
Termination of website access does not remove obligations relating to accepted orders, refunds, consumer guarantees or other rights that continue by their nature.
Section 16 – Consumer guarantees and warranties
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
If a product has a major failure, you may be entitled to choose a refund or replacement. For other failures, we may be required to repair or replace the product within a reasonable time. Other remedies may also be available depending on the circumstances.
Any additional warranty or voluntary returns policy offered by Noosa Mode operates alongside, and does not replace, these statutory rights.
Section 17 – Limitation of liability
Nothing in these Terms excludes, restricts or modifies:
-
Your rights under the Australian Consumer Law
-
Liability that cannot lawfully be excluded
-
Liability arising from fraud, deliberate misconduct or gross negligence
To the extent permitted by law, we are not responsible for losses that are indirect, unforeseeable or not reasonably connected to our breach of these Terms.
Where liability can lawfully be limited, our liability will be limited only to the extent permitted by applicable law.
Section 18 – Your responsibility
You are responsible for losses reasonably resulting from your unlawful use of the Services, deliberate misconduct or material breach of these Terms.
Nothing in this section requires you to compensate us for losses caused by our actions, losses that are not reasonably foreseeable or liabilities that cannot lawfully be imposed on you.
Section 19 – Severability
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in effect where they can operate independently.
Section 20 – No waiver
If we do not immediately exercise a right under these Terms, that does not mean we have waived that right.
A waiver is effective only when expressly confirmed by the party granting it.
Section 21 – Entire agreement
These Terms and the policies referenced in them form the agreement governing your use of the Services.
They replace previous versions relating to the same subject matter but do not exclude representations or rights that cannot lawfully be excluded.
Section 22 – Assignment
You may not transfer your rights or obligations under these Terms without our written consent.
We may transfer our rights or obligations as part of a legitimate restructuring, sale or transfer of the business, provided this does not reduce your existing rights or remedies.
Section 23 – Governing law
These Terms are governed by the laws applicable in [jurisdiction of your registered business].
If you are an Australian consumer, nothing in this section excludes the application of the Australian Consumer Law or any mandatory rights available to you under Australian law.
Any dispute will be handled by a court or tribunal with lawful jurisdiction over the matter.
Section 24 – Changes to these Terms
We may update these Terms to reflect changes to our Services, business practices or legal obligations.
The current version will be published on this page with its updated date. Material changes will apply prospectively unless applicable law requires otherwise.
Changes will not remove rights that have already arisen in connection with an accepted order.
